The Range of Penalties for First-Offense DUI/DWI
If you are convicted of a first-offense DUI or fourth-degree DWI, the penalties can range from a fine and mandatory alcohol treatment to 90 days in jail and a 90-day driver's license suspension. The fines are increased if you had a high blood-alcohol concentration (BAC over .20), had a child in the vehicle, or refused to submit to required blood, breath or urine chemical testing.
Fighting to Reduce or Dismiss Your Charges
There is no mandatory minimum jail sentence for first-time drunk driving offenders. There are other options. We often have alcohol assessments done, because if we can show the court that you are not likely to re-offend, it may reduce your penalties.
